With graphic new video surfacing of Baltimore Ravens running back Ray Rice knocking out his fiancée at the time, Janay Palmer (now Janay Rice), the question is whether the NFL will increase Rices two-game suspension. Yes - its possible. In order to do so, the video will have to be new to the league as well as the account of what happened. If the league never saw the video and was not made aware of Rices left hook knockout punch, then that could be grounds to increase Rices suspension. While the NFL is an economic behemoth, the assumption should not necessarily be that it got its hands on the video. The league does not have subpoena power (or the ability to compel the production of evidence). That is not to say the NFL did not see it. Still, to assume the league did see it is perhaps premature. If NFL officials previously viewed the video, and it was part of the leagues deliberations, Commissioner Roger Goodell will not be able to increase the suspension. Rice cannot be punished twice for the same offence even in the face of public backlash. And the NFLPA will make sure of that. As well, if the league never viewed the video, but Rice and Janay came clean as to what precisely happened in the elevator that night, the suspension wont change. There were some reports that Janay was hitting Rice before she was struck. As per the video, however, that does not appear to be the case. We will see if that represents meaningful information and suggests an alteration of the truth. So the critical question to be addressed is whether this is new to the NFL. The prosecution could have pursued a case against Rice without the cooperation of his fiancée. Generally, without the cooperation of the victim, the prosecution can have a difficult time. That would not be unprecedented. For example, back in 2008, the Steelers suspended Santonio Holmes one game for marijuana possession.
